LEGAL

Terms of Use

Effective October 12, 2026

These terms are a legally binding agreement between you and Analyst House LLC ("Analyst House", "we", "us"). They cover our website at analysthouse.io and our software, including our client portal and its connection to QuickBooks Online. By using either, you agree to these terms and to our privacy policy, which is part of them. If you do not agree, do not use our website or software.

If you use our software on behalf of a business, you confirm that you are authorized to accept these terms for that business, and "you" includes the business.

Our accounting and advisory services are governed by your engagement letter. Wherever it conflicts with these terms, your engagement letter controls.

Who can use our website and software

You must be at least 18 years old. Our software is available only to our clients and the people they authorize, and only for business purposes.

Our website

No professional advice. Content on our website is general information, not accounting, tax, legal, or financial advice. Reading it or contacting us does not make you our client. That only happens when we both sign an engagement letter.

Our content. We own the content, design, logos, and trademarks on our website. You may read and share it for personal or internal business use, but you may not copy, republish, or sell it for commercial purposes without our written permission.

Other sites. Our website links to sites and services we do not control, such as our scheduling provider. We are not responsible for their content or practices.

Our software

Our client portal and the software we use to deliver our services are provided to support your engagement. This section applies when you connect your QuickBooks Online company to our software, answer questions we send through it, sign in to the client portal, or otherwise use them.

Your account

You agree to give us accurate information and keep it up to date, keep your login secure, and not share it. You are responsible for activity under your account, and you will tell us promptly if you believe someone has accessed it without permission.

Connecting QuickBooks Online

By connecting a QuickBooks Online company, you confirm that you have the authority to do so, and you authorize us to read that company's accounting data, and to update it as part of our services, for as long as the connection stays active. You can disconnect at any time from the apps area of your QuickBooks Online account, or by asking us. What we do with QuickBooks data, and what happens to it after you disconnect, is described in our privacy policy.

Acceptable use

You agree not to:

  • Use our software for anything unlawful, or for any purpose other than the one we provide it for
  • Access, or try to access, data that is not yours or parts of our systems that are not meant for you
  • Interfere with, disrupt, or overload our website or software, or probe them for vulnerabilities without our written permission
  • Copy, modify, reverse engineer, or resell our software, or use it to build a competing product
  • Use bots, scrapers, or other automated tools to access our website or software, other than through features we provide
  • Upload anything containing malware, or that you do not have the right to share

Your data

You own your data, including your QuickBooks data and the documents you share with us. You give us permission to use it only to provide our services to you, as described in our privacy policy. We do not sell it, and we do not use it to train AI models.

If you send us feedback or suggestions about our software, we may use them without any obligation to you.

AI features

Our software uses business versions of AI tools. AI output can contain mistakes. Treat AI-generated answers as information, not professional advice, unless our team has confirmed them.

Fees

There is no separate charge for our software. Fees for our services are set in your engagement letter. If you add a payment method in our software, you authorize us and our payment processor to charge it for the fees in your engagement letter, including recurring fees, until you cancel as your engagement letter allows.

QuickBooks and other services

QuickBooks Online is provided by Intuit under Intuit's own terms, and your use of it is between you and Intuit. Intuit is not a party to these terms and is not responsible for our software. We are not responsible for the availability or accuracy of QuickBooks Online or other third-party services. QuickBooks and QuickBooks Online are trademarks of Intuit Inc.

Ownership

We and our licensors own our software and everything in it, other than your data. These terms give you a limited right to use it as described here, and no other rights.

Changes and availability

We may update, change, or stop offering parts of our software at any time. We work to keep it available, but cannot promise it will always be available or free of errors, and we may take it down for maintenance.

Suspension and ending your use

You can stop using our software at any time by disconnecting QuickBooks Online and no longer signing in to the client portal. We may suspend or end your access if you break these terms, if your engagement with us ends, or if we need to protect our systems, our clients, or you. When your access ends, the sections of these terms that by their nature should continue, such as ownership, disclaimers, liability, and indemnity, continue to apply. You can ask us for a copy of your data, and we will handle it as described in our privacy policy.

General terms

Disclaimer

Except as stated in your engagement letter, and to the extent the law allows, our website and software are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms limits our professional obligations to you under your engagement letter.

Limitation of liability

Except as stated in your engagement letter, and to the extent the law allows:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of our website or software, even if we were told they were possible.
  • Our total liability for any claim relating to our website or software is limited to the fees you paid us for our services in the six months before the claim arose.

Some states do not allow some of these limits, so they may not all apply to you.

Indemnity

You agree to defend and hold Analyst House and its team harmless from third-party claims, and the reasonable costs of defending them, that arise from your misuse of our website or software, your breach of these terms, or your violation of anyone else's rights.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. If a dispute arises, we each agree to first try to resolve it informally for at least 30 days after one of us sends the other written notice. If that does not resolve it, the dispute will be decided in the state or federal courts located in Harris County, Texas, and we each consent to those courts' jurisdiction. Claims must be brought individually, not as part of a class or representative action.

Electronic communications

You agree that we can send you notices, agreements, and other communications electronically, by email or through the client portal, and that they satisfy any legal requirement that they be in writing.

Changes to these terms

If we change these terms, we will post the new version here and update the effective date above, and we may also let our clients know directly. Continuing to use our website or software after a change means you accept the new terms.

Other terms

These terms, our privacy policy, and your engagement letter are the entire agreement between us about our website and software. If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a provision right away, we have not waived it. You may not transfer these terms without our written consent; we may transfer them as part of a merger, acquisition, or sale of our business. We are not responsible for delays or failures caused by events beyond our reasonable control. These terms do not create a partnership, joint venture, employment, or agency relationship.
